Terms & conditions

Hochgrat Panorama Suite Terms and Conditions

1. Scope

These Booking and Cancellation Conditions apply to all direct bookings made with the Hochgrat Panorama Suite, including bookings made through the property’s own website, by email, or by telephone. For bookings made through third-party platforms, such as Booking.com or Airbnb, the booking and cancellation conditions displayed on the respective platform at the time of booking shall take precedence. By completing a direct booking, the guest accepts these Booking and Cancellation Conditions, the Terms & Conditions, and the House Rules of the Hochgrat Panorama Suite.

2. Booking and Formation of the Contract

The presentation of the accommodation on the website does not constitute a legally binding offer. A binding accommodation agreement is concluded when: the guest submits a booking request or completes the online booking process, the Host confirms the booking in writing or electronically, and where applicable, the required deposit or payment has been received. The person making the booking must be at least 18 years old and is responsible for fulfilling all contractual obligations on behalf of all accompanying guests. The booking confirmation will specify the booked travel period, number of guests, total accommodation price, payment terms, and applicable cancellation conditions.

3. Prices and Additional Charges

The total price stated in the booking confirmation applies to the accommodation and services included in the booked rate. Unless expressly stated otherwise, the following may be charged separately: Local visitor’s tax Baby cot Optional additional services Costs resulting from damage, excessive soiling, or violations of the House Rules The local visitor’s tax is not part of the accommodation price and will be charged in accordance with the applicable local regulations.

4. Payment Conditions

Unless different payment terms are stated during the booking process, the full accommodation price is due no later than 30 days before arrival.   For bookings made less than 30 days before arrival, the full accommodation price is due immediately upon confirmation of the booking.   The booking is considered confirmed once the accommodation price has been paid in full.   In addition to the accommodation price, the applicable local visitor’s tax (Kurtaxe) will be charged separately in accordance with the regulations of the municipality of Oberstaufen valid at the time of the stay.   The visitor’s tax is not included in the accommodation price and must be paid in full prior to arrival. The corresponding invoice and payment instructions will be provided before check-in.   The Allgäu-Walser Pass can only be issued once the visitor’s tax has been paid.   The Host is under no obligation to grant access to the property until all outstanding amounts, including the accommodation price and visitor’s tax, have been paid in full.   The Host reserves the right to withhold access instructions, key collection information, access codes, smart-lock credentials, or any other means of entry until all outstanding payments have been received.   If payment is not received by the applicable due date, the Host may set a reasonable additional payment deadline. If payment is still not received, the Host may withdraw from the accommodation agreement and make the apartment available to other guests.   Any applicable cancellation charges remain unaffected.

5. Cancellation by the Guest

Cancellations must be submitted in text form, preferably by email. The date on which the cancellation notice is received by the Host determines the applicable cancellation charge. Unless different cancellation conditions were expressly agreed upon during the booking process, the following conditions apply to direct bookings: Up to 30 days before arrival: free cancellation 29 to 15 days before arrival: 50% of the total booking price 14 to 8 days before arrival: 80% of the total booking price 7 days or less before arrival: 90% of the total booking price No-show or early departure: 90% of the price of the unused accommodation services The guest remains entitled to demonstrate that no loss was incurred or that the actual loss is significantly lower than the cancellation charge. The Host will make reasonable efforts to re-let the apartment. Any income received from re-letting the accommodation for the cancelled period, as well as any expenses saved as a result of the cancellation, will be deducted from the cancellation charge. Any amount exceeding the final cancellation charge will be refunded to the guest.

6. Changes to the Travel Dates

Requests to change the booked travel dates are subject to availability and require the Host’s approval. A change of travel dates does not constitute an automatic entitlement and may result in a price adjustment. If the requested change cannot be accepted, the booking will remain valid for the originally confirmed travel dates. If the guest subsequently cancels the booking, the applicable cancellation conditions will apply. At the Host’s discretion, a cancellation charge may be credited toward a new booking. Any such arrangement must be confirmed in writing and does not establish an entitlement to future changes or credits.

7. No-Show and Early Departure

If the guest does not arrive and has not cancelled the booking, the reservation will be treated as a no-show. If the guest arrives later, departs earlier, or does not use individual accommodation services for personal reasons, no entitlement to a full or partial refund arises. The Host will, however, deduct saved expenses and any income received from re-letting the apartment from the amount payable.

8. Travel Cancellation Insurance

Guests are strongly advised to take out appropriate travel cancellation insurance. Illness, accidents, changes to personal or professional plans, transport disruptions, or similar circumstances affecting the guest generally do not automatically release the guest from the agreed payment and cancellation obligations. Any mandatory statutory rights remain unaffected.

9. Cancellation by the Host

The Host may cancel the booking for good cause, particularly if: the accommodation cannot be provided due to serious damage or circumstances beyond the Host’s reasonable control, the guest provides false or misleading booking information, the guest fails to make payments by the agreed deadlines, there is a justified reason to believe that the accommodation will be used unlawfully or in serious violation of the House Rules. If the Host is unable to provide the accommodation for reasons for which the guest is not responsible, all payments already made for the affected stay will be refunded. Further claims are excluded unless the Host acted intentionally or with gross negligence or mandatory statutory provisions provide otherwise.

10. Withdrawal and Statutory Rights

For accommodation services provided on a specific date or during a specific period, there is generally no statutory 14-day right of withdrawal. The booking is therefore binding once the accommodation agreement has been concluded. The guest’s right to cancel the booking is governed by the cancellation conditions stated above. Mandatory statutory rights, particularly in the event of a material defect in the accommodation, remain unaffected.

11. Check-in and Check-out

Check-in is available from 4:00 PM on the day of arrival. Check-out must be completed by 10:00 AM on the day of departure. Any different arrival or departure times require prior written approval by the Host. Additional costs caused by an unauthorized late departure, including additional cleaning expenses or compensation payable to subsequent guests, may be charged to the departing guest based on the actual costs incurred.

12. Maximum Occupancy

Only the number of guests stated in the booking confirmation may stay in the apartment. Additional guests require the Host’s prior approval and may result in an additional charge. The maximum permitted occupancy of the Hochgrat Panorama Suite must not be exceeded. Children and infants must also be included in the booking information, even if no separate bed is required.

13. House Rules

The House Rules form an integral part of the accommodation agreement. The guest making the booking is responsible for ensuring that all accompanying guests and visitors comply with the House Rules. Serious or repeated violations, including unauthorized parties, smoking inside the apartment, excessive noise, unauthorized pets, or exceeding the maximum occupancy, may result in termination of the accommodation agreement. In such cases, the guest is not automatically entitled to a refund. Saved expenses and any income received from re-letting the apartment will nevertheless be taken into account.

14.Damages and Additional Costs

Guests are responsible for damage caused intentionally or negligently by themselves, accompanying guests, children, or visitors. Any damage must be reported to the Host immediately. The guest may be charged for the actual costs of: Repairing or replacing damaged property Special cleaning Odor removal or textile cleaning Damage caused by unauthorized smoking or pets Water or moisture damage caused by windows or roof windows being left open Lost keys or access devices Additional waste disposal Loss of rental income directly resulting from damage caused by the guest The Host will provide reasonable evidence of the costs claimed.

15. Governing Law

The laws of the Federal Republic of Germany apply. Mandatory consumer protection provisions applicable at the guest’s habitual place of residence remain unaffected. Any agreement regarding the place of jurisdiction applies only where legally permissible.

16. Force Majeure

Neither the Host nor the Guest shall be liable for any failure or delay in performing their contractual obligations where such failure or delay is caused by events beyond their reasonable control ("Force Majeure Events"). Force Majeure Events may include, but are not limited to: Natural disasters, including storms, floods, landslides, earthquakes, or severe weather events Fire, explosion, or major damage to the property Government actions, travel restrictions, border closures, or mandatory evacuations Epidemics, pandemics, or other public health emergencies War, terrorism, civil unrest, or acts of public authorities Prolonged interruption of utilities, including electricity, water supply, or telecommunications, where such interruption is beyond the Host's control If a Force Majeure Event makes the accommodation unavailable or unsafe, the Host may cancel the booking without liability. In such cases: Any payments already received for accommodation services that cannot be provided will be refunded. Neither party shall have any further claim for damages, compensation, loss of enjoyment, loss of profit, travel expenses, or consequential losses. Guests are responsible for their own travel arrangements and are strongly encouraged to obtain appropriate travel insurance. If a Force Majeure Event affects only part of the booked stay, the Host may refund the affected portion of the accommodation price on a pro-rata basis. Nothing in this clause shall limit any mandatory statutory rights that cannot legally be excluded.
